Terms and Conditions

Effective date: March 30, 2026

§ 1. General Provisions

These Terms and Conditions (hereinafter "Terms") govern the use of the Monfimo website at monfimo.com and the Monfimo application at app.monfimo.com (hereinafter collectively referred to as the "Service"), including the conditions for electronic service provision, contract formation and termination, and the complaint procedure.

The Service is operated by Przemek Zakoscielny, conducting business at Kanadyjska 28, 32-087 Zielonki, Poland (hereinafter referred to as the "Provider", "we", "us", or "our").

By creating an account or using the Service, you accept these Terms in their entirety. If you do not agree with any provision of these Terms, you should not use the Service.

§ 2. Definitions

3.1 Free Services

The following services are provided free of charge:

The Free Plan is available indefinitely with no time limit. It does not automatically convert to a Paid Plan.

3.2 Paid Services

Paid Plans (Pro and Business) offer expanded invoice limits, Excel export, priority or premium support, and additional features as described in the Price List. Access to Paid Plans requires placing an order and making payment in accordance with the Price List.

3.3 Service Availability

The Provider endeavours to ensure continuous Service availability seven days a week. Planned maintenance windows may require temporary suspension of the Service. Users will be notified of planned downtime via email or Account notification at least 24 hours in advance.

3.4 Liability Limitation

The Provider shall not be held liable for Service disruptions caused by force majeure, equipment failure, power outages, network threats, unauthorised third-party interference, or User non-compliance with these Terms.

Any liability of the Provider shall be limited to actual losses suffered by the User and shall not exceed the total amount of fees paid by the User for the current Settlement Period.

§ 4. Technical Requirements and Usage Rules

Users must use the Service in accordance with its intended purpose and comply with applicable law. The following actions are prohibited:

The Provider reserves the right to immediately restrict or terminate access to the Service in the event of a violation of these rules.

4.3 Security

The Provider informs Users of potential security threats associated with the use of electronic services, including malware, phishing, and unauthorised access attempts. Users are encouraged to use up-to-date antivirus software, maintain firewalls, and regularly update their systems and browsers.

§ 5. Account

5.1 Registration

Account registration is completed by filling in the registration form with truthful data and accepting these Terms and the Privacy Policy. The contract for electronic service provision is concluded upon Account activation.

5.2 Access and Security

Access to the Account requires authentication with an email address and password. The User is responsible for maintaining the confidentiality of their login credentials. The Provider recommends using strong, unique passwords and changing them regularly.

The Provider shall not be held liable for any consequences arising from the User sharing their login credentials with third parties.

5.3 Account Deletion

The User may request deletion of their Account at any time by sending a request to support@monfimo.com. Upon Account deletion, the User's data and uploaded Documents will be removed from the Service, subject to any applicable legal retention requirements.

The Provider may block or delete an Account without notice in the event of a violation of § 4.2 of these Terms.

§ 6. User Content and Ownership

Users retain full ownership of all Documents and data they upload to the Service. The Provider does not claim any ownership rights over User-uploaded content.

By uploading Documents to the Service, the User grants the Provider a limited, non-exclusive right to process the content solely for the purpose of delivering the Service (including AI-powered data extraction and reconciliation). This right terminates upon Document deletion or Account termination.

The User warrants that they have the legal right to upload and process all Documents submitted to the Service and shall indemnify the Provider against any third-party claims arising from a breach of this warranty.

§ 7. AI Document Processing

The Service uses third-party AI providers — specifically Google (Gemini API) and Anthropic (Claude API) — to extract structured financial data from uploaded Documents. Document content is sent to these providers solely for the purpose of data extraction.

The Provider relies on the data processing agreements and privacy commitments of these AI providers. Neither Google nor Anthropic use data submitted through their APIs to train their public models.

The User acknowledges and accepts that Document content is transmitted to these third-party AI providers as a necessary part of the Service's functionality.

§ 8. Payments

8.1 Payment Terms

Users on Paid Plans are required to pay fees in advance in accordance with the Price List. Payment is due immediately upon placing an order for a Paid Plan.

8.2 Payment Methods

Payments are processed by Stripe. Accepted payment methods include Visa, Mastercard, and American Express. Payment card details are processed directly by Stripe and are not stored on the Provider's servers.

8.3 Recurring Payments

Paid Plans are billed on a recurring basis (monthly or yearly) depending on the selected Settlement Period. The User may cancel recurring payments at any time; the cancellation takes effect at the end of the current Settlement Period.

8.4 Invoices

Electronic invoices are issued and delivered to the User's registered email address within 7 days of receiving payment.

8.5 Refunds

Refunds, when applicable, are credited to the bank account associated with the payment card used for the original transaction.

§ 9. Contract Termination

9.1 Termination by User

The User may terminate the contract at any time by requesting Account deletion via email to support@monfimo.com.

9.2 Termination by Provider

The Provider may terminate the contract with immediate effect if the User:

9.3 Termination for Operational Reasons

The Provider may terminate the contract for operational reasons (including cessation of the Service, significant changes in legislation, or material changes in business circumstances) by providing at least 60 days' notice via email. In such case, fees paid for any period beyond the termination date will be refunded.

§ 10. Complaint Procedure

Complaints should be sent to support@monfimo.com and should include:

The Provider will respond to the complaint within 14 days of receipt via email to the address provided by the User.

§ 11. Right of Withdrawal

Users who qualify as consumers or sole proprietors with consumer rights under Polish law have the right to withdraw from the contract within 14 days of its conclusion, without providing any reason.

To exercise the right of withdrawal, the User must send a clear statement to support@monfimo.com before the 14-day deadline expires.

Upon valid withdrawal, the Provider will refund all fees paid within 14 days of receiving the withdrawal notice, using the same payment method as the original transaction, without any additional charges.

§ 12. Technical Support

Technical support is provided to all Users for the duration of their contract and is included in the Service fees for Paid Plans.

Support requests should be sent to support@monfimo.com with a description of the issue or bug encountered.

The Provider will respond to support requests within 72 hours of receipt.

Technical support does not cover issues arising from the User's failure to meet the technical requirements specified in § 4.1 or from unauthorised modifications to Account settings.

§ 13. Intellectual Property

The Service — including its software, design, graphics, logos, text, and all other content — is protected by intellectual property law. Copying, distribution, modification, or any other use of the Service's content without the Provider's prior written consent is prohibited.

By using the Service, the User is granted a non-exclusive, non-transferable licence to use the Service in accordance with these Terms and for its intended purpose. This licence does not entitle the User to grant sub-licences. The licence is valid for the duration of the User's Account and expires upon Account deletion.

§ 14. Personal Data

The Provider processes personal data of Users in accordance with applicable law, including the General Data Protection Regulation (GDPR). Detailed information about data processing is available in the Privacy Policy.

§ 15. Dispute Resolution

§ 16. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Poland, including in particular the Civil Code, the Consumer Rights Act, the Copyright and Related Rights Act, the General Data Protection Regulation (GDPR), and the Act on Provision of Electronic Services.

Any disputes arising from or in connection with these Terms that cannot be resolved amicably shall be submitted to the competent court in Kraków, Poland, unless mandatory consumer protection provisions provide otherwise.

§ 17. Amendments to the Terms

The Provider reserves the right to amend these Terms in the event of:

Users will be notified of any amendments at least 14 days before their planned effective date via notification on the Service and email to the registered address.

If the User does not object to the amendments within 14 days of receiving notice, the amended Terms are deemed accepted. If the User objects (by sending an email to support@monfimo.com), the contract terminates on the day preceding the effective date of the amendments.

§ 18. Final Provisions

These Terms, together with the Privacy Policy and the Price List, form the complete agreement between the User and the Provider regarding the use of the Service.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms are effective as of March 30, 2026.
